RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03880 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her Fitness Assessment (FA) dated 26 Jul 13 be corrected to reflect “Satisfactory” in the Air Force Fitness Management System (AFFMS). APPLICANT CONTENDS THAT: In accordance with AFI 36-2906, Fitness Program, the AFI was on a 180 day AF Guidance Memorandum, dated 3 Jan 13 and expired on 3 Jul 13. As such, the current FA guidance is deferred to the previous regulation, AFI 10-248, Air Force Fitness Program, in which a cumulative score of 75% counts as passing. This supersedes the previous instruction that states member must meet the minimum requirements for each four components to pass the test. Her FA results on 26 Jul 13, which her records reflect a 30 inch waist, completion of 34 push-ups, completion of 23 sit-ups and a run time of 14:43 equals a total score of 80.30%. In support of her request, the applicant submits copy of her Air Force Fitness Management report, dated 1 Aug 13, an excerpt from AFI 10-248, dated 24 May 05, and Air Force Guidance Memorandum 5 for AFI 36-2905, dated 3 Jan 13. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Staff Sergeant. The applicant’s last five FA scores are as follows: Date Score 07 Oct 14 Excellent 18 Oct 13 Excellent * 26 Jul 13 Unsatisfactory 19 Feb 13 Satisfactory 24 Oct 11 Satisfactory * Contested FA score The applicant originally submitted her BCMR application on 19 Aug 13 but was returned due to the absence of her signature. The applicant’s resubmission was received on 6 May 14. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or an injustice. In accordance with AFI 36-2905, dated 21 October 2013, any military member can appeal their FA via Wing Appeal and subsequently through the Air Force Fitness Assessment Appeals Board (FAAB), within two years of discovering an error or injustice. In this case, the applicant's DD Form 149 was signed on 31 Dec 13 and the appeal has not been considered by her Wing Commander, nor has it been reviewed by the FAAB; therefore, the applicant's request has not been submitted in accordance with current Air Force guidance. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 27 Jun 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has not exhausted all remedies provided by existing law or regulations. 2. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. In this respect, we note this Board is the highest administrative level of appeal within the Air Force. As such, an applicant must first exhaust all available avenues of administrative relief provided by existing law or regulations prior to seeking relief before this Board, as required by the governing Air Force Instruction. The Air Force office of primary responsibility has reviewed this application and indicated there is an available avenue of administrative relief the applicant has not first pursued. Therefore, in view of the above, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that she has not exhausted all available avenues of administrative relief prior to submitting her application to the BCMR; and the application will only be reconsidered upon exhausting all subordinate avenues of administrative relief.
